Nice capture! Yeah, Grimp strictly speaking it is. However, I doubt a prosecution would occur if you were shooting from a suitable distance with a telephoto lens

The law protects allwild birds and it is an offence to disturb them or their nests, I don't think that taking photos is part of that law unless one causes distress or disturbance.
